General Terms & Conditions

1) This policy shall only be applicable to the customer ("Customer") purchased the item via www.deluxecirclefreshmart.com.my ("Website") or De Fresh Mart App ("App")

2) De Luxe Circle Fresh Mart ("The Company") reserves the right to update the terms and conditions in this policy at any time without prior notice. In the event that any changes are made, the revised terms and conditions shall be posted on the app/website. 


Shipping Policy

Delivery and self-pickup service need to be booked one day in advance.

The order cut-off time for next-day delivery or self-pickup service is 4pm.

1) Home Delivery area within Johor Bharu, Skudai, Kulai and Senai:

1.1) Order 1 day in advance, order cut off on everyday 4pm

1.2) 1st order will start to deliver from 10am, and last delivery will be at 8pm

1.3) The delivery fee is as follow

       a) Base rate: RM6.00

       b) Next every 1km: RM1.00

The delivery fee is subject to change without prior notice.

1.4) The distance of delivery will be calculated from the following online outlets, which depend on the selected outlet:

a) De Luxe Circle Fresh Mart Sri Yacoob

b) De Luxe Circle Fresh Mart Setia Indah

c) De Luxe Circle Fresh Mart Megah Ria

d) De Luxe Circle Fresh Mart Sri Tebrau

e) De Luxe Circle Fresh Mart Kulai

1.5) The customer is required to contact our customer service center at 012-709 2889 for the following circumstances:

a) If there are any changes in the delivery address/contact details made during submission of order and confirmed delivery date

b) Rescheduling on goods delivery

c) Change on delivery time

d) Request for a specific delivery period

1.6) No amendment on order is allowed once the order is processed.

1.7) The Company reserves the right to deliver only to the main entrance of the delivery address.

1.8) The customer was responsible to ensure that the delivery information entered in the website/mobile app is accurate and complete. De Luxe Circle Fresh Mart will not be liable for late delivery or non-delivery of the order resulting from incorrect delivery information.

1.9) If there is no assigned person to receive the goods at the agreed time and place specified by the Customer, the company will leave a notification on the attempt to deliver was not successful and the Customer has to contact customer services to arrange for redelivery.

1.10) Upon request on redelivery, the Company will charge an additional redelivery fee for providing the service.


2) Self-Pick Up @ De Luxe Circle Fresh Mart:

2.1) The time slot for collect order will be 10am to 8pm

2.2) There is no charge for self-pickup at selected De Luxe Circle Fresh Mart

2.3) Customer may choose to self-collect the order at the following outlets:

a) De Luxe Circle Fresh Mart Sri Yacoob

b) De Luxe Circle Fresh Mart Setia Indah

c) De Luxe Circle Fresh Mart Megah Ria

d) De Luxe Circle Fresh Mart Sri Tebrau

e) De Luxe Circle Fresh Mart Kulai

2.4) The pick-up point is at the Cashier Counter in all our outlets.

2.5) The customer is required to contact our customer service center at 012-709 2889 for the following circumstances:

a) Change of the pick-up time

b) Request for the specific pick-up time

2.6) No amendment on order is allowed once the order is processed.


3) Home Delivery within West Malaysia:

3.1) Home Delivery service is available to purchase within West Malaysia

3.2) This service only applied to non-fresh products & non-frozen products.

3.3) The parcel will be delivered by the appointed delivery courier company

3.4) The delivery fee is as follow:

a) First 1kg - RM5.30

b) Next every 500gm - RM2.00

The delivery fee is subject to change without prior notice.

3.5) Delivery will be available from Monday to Friday during office hours, excluding weekends and Public Holidays.

3.6) Delivery ordered will be delivered in 5 - 7 working days

3.7) The customer required to contact our customer service center at 012-709 2889 if there are any changes in the delivery address/contact details made during submission of the order and confirmed delivery date

3.8) No amendment on order is allowed once the order is processed.

3.9) The customer was responsible to ensure that the delivery information entered in the website/mobile app is accurate and complete. De Luxe Circle Fresh Mart will not be liable for late delivery or non-delivery of the order resulting from incorrect delivery information.

3.10) Upon request on redelivery, the Company will charge an additional redelivery fee for providing the service.


Cancellation & Refund Policies

1) Cancellation

1.1) The Company has the right to cancel the order if the product is not available for any reason. We will notify you of the order cancellation and return the payment made. The refund will subject to the bank processing period.

1.2) You are not allowed to cancel the order once Confirmation of the Order issued.

2) Refund

2.1) Please inspect your order upon received.

2.2) Refund must be requested:  

a) on the same day of goods received for fresh and perishable products;

b) within 3 days from goods received for frozen, grocery, and non-food products.

2.3) Refund is allowed in the following circumstances:

a) Defective and/or damaged on delivery;

b) Wrong item;

c) Discrepancies in quantities of the products;

d) The products are expired before order.

2.4) Goods returned for a refund shall be refunded at the price on the original receipt issued.

2.5) In the event of a refund, all member points received on the purchase of the refunded goods will be removed from the De Luxe Membership account.

2.6) Refund Procedures

a) To request a refund, please call or email our customer service center at 012-709 2889 or customercare@deluxegroups.com;

b) Customer is responsible to provide proof of purchase and product photo;

c) Customer is responsible to return defective/damaged products in the same condition that received, unworn or unused, with tags, and in its original packaging.

d) If the request for a refund meets the criteria, a refund will be process and subject to a bank processing period.


De Fresh Card Membership Policy

1. General Terms & Condition

1.1) The De Fresh Club ("Program") is a loyalty program by De Luxe Circle Fresh Mart Sdn Bhd ("The Company"). A registered member ("Member") who has a De Fresh Club account ("Account") can enjoy special promotions and privileges by earning Reward Points ("Points") for cash rebates.

1.2) This Program is available through the De Fresh Mart app ("App") which is available for iOS and Android.

1.3) No physical card will be issue to become a Member; Members are required to download the App from the App Store or Google Play, and then register for an account to become a Member.

1.4) To enjoy the Program, Member needs to flash Member ID Barcode on the App and get it scanned every time spend at any De Luxe Circle Fresh Mart (except Puchong outlet). The App will be used to earn and redeem points.

1.5) Employee under De Luxe Groups and promoters perform their duty at De Luxe Circle Fresh Mart are not allowed to use their account during working hours and strictly not earning points on customer purchases.


2. Membership

2.1) To be a Member, download the App from the App Store or Google Play and register via the App.

2.2) Applications are open to all customers aged 18 years and above.

2.3) Each mobile number and NRIC or passport can be registered for ONE account only.

2.4) Members should safeguard their username and password. Any person using the site with their username and password is either the Member or is authorized to act for the Member.

2.5) Membership will expire if the Members did not use the Account to earn points for continuous 12 months.

2.6) This Membership is applicable in all De Luxe Circle Fresh Mart, except the Puchong outlet.

2.7) Membership is not transferable.

2.8) Members should always update their registered contact details in their account to ensure that they do not lose their collected Points as well as to enjoy the full member benefits. To update personal details, members can log in to their account on the App or contact our Customer Service team via email at customercare@deluxegroups.com.

2.9) The Company reserved the right to use and utilize the member database for the company's marketing purposes.

2.10) All members' information is protected by Personal Data Protection Act 2010.  


3. Points Collection and Redemption Mechanism

3.1) 1 point earned for every RM1.00 net spent except non-qualifying products such as mobile reload, cigarettes, wine, liquor, as well as product announced by the Company as needed.

3.2) Members are eligible to redeem RM10.00 instant cash rebate for every 2,000 points accumulated, or RM50.00 for every 9,800 points accumulated.

3.3) Members must present their membership Barcode via App to earn or redeem Points. A screenshot of the Barcode is invalid for this purpose.

3.4) There shall be no accumulating of Points for backdated receipts.

3.5) Points earned will expire 12 months from the date the Points were earned.

3.6) The redemption of Points from a Member's account will be on "first expired" basic. The Points that are soonest to expire will be deducted first.

3.7) Members can check their Points balance and accumulated Points on the App or website. The Company reserves the right to correct or amend the balance in a Member's account if The Company confirmed that an invoicing or accounting error has occurred.

3.8) Redemption of Points in a single transaction can only be made by using the Points from the same account.

3.9) Members cannot transfer points to any other person.

3.10) It is not possible to merge the Points from more than one account into a single account.

3.11) Any Points expired, redeemed, and deducted are not refundable.


4. Limitations Of Use Of Membership

4.1) The Company shall not be liable for any damage in the event that the account could not be used due to whatsoever reason, including but not limited to failure of IT and communication systems, as The Company may not allow Members to redeem or reward points during such an event.

4.2) The company reserves the right to refuse any application for an account or to impose a limitation on the usage of the account, in the event The Company believes that the elements of fraud, misconduct, or unauthorized use involved in the transaction. The Company may at any time suspend or cancel the account of the Member if The Company believes that the account has been used for or is intended to be used for fraud, misconduct, or other unauthorized uses. In the case of such an event, the Membership will be invalid once suspended or canceled by The Company, and all the reward points will be forfeited.


5. Cancellation

5.1) The application fee is non-refundable.

5.2) In the event a Member wants to cancel their Membership, the Member must contact our Customer Service team via email at customercare@deluxegroups.com.

5.3) All the remaining rewards and earned points in the Membership account will be forfeited upon termination of the Membership.

5.4) All the remaining earned points are not allowed to transfer to another account.

 

6. Termination

6.1) In the event The Company decides to terminate this Program, The Company will give a 30 days' notice to Members.

 

7. Company Rights

7.1) The Company reserves the right to update the terms and conditions in this policy at any time without prior notice. In the event that any changes are made, the revised terms and conditions shall be posted on the app/website.

Pricing:  The prices published on www.deluxecirclefreshmart.com.my website and mobile app may differ with store (due to promotion start/end, new packaging, weight change, and etc.).

The final price will be the price on the day the goods are picked for delivery.

 

Product Availability:  Confirmation e-mail does not guarantee that all the items you ordered will be available or we will be able to send your order.

 

Since our stock fluctuates throughout the day, all products displayed on the website are subject to final confirmation of availability at corresponding outlets on the day the goods are picked for delivery.

 

In some cases, the product you ordered is NOT described as out of stock during the purchase period, but it may NOT be available during the picking period. We will notify you via in-app notification/email as soon as we begin to process your order.

 

Fees:  Where applicable, you shall be charged according to the prices stated on this site and other miscellaneous fees such as delivery fees, administrative fees and returning fees, and etc. inclusive of goods and service tax (GST).

 

SECTION 5 - PRODUCTS OR SERVICES

Certain products or services on the website may have limited quantities and are subject to return or exchange only according to our Return Policy.

 

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. Some images for the products might be outdated and we also cannot guarantee that your computer monitor's display of any color will be accurate.
